August 5, 2019: A Dark Chapter for Kashmiri Identity, Right to Self-Determination and International Law

August 5 is observed as Kashmir Exploitation Day, symbolizing the concerns raised by Pakistan and Kashmiri groups regarding the right to self-determination and the preservation of Kashmiri identity in Indian Occupied Kashmir (IOK).

On August 5, 2019, India revoked Articles 370 and 35A of its Constitution, unilaterally ending the special constitutional status previously granted to Jammu and Kashmir. The move triggered strong reactions from Pakistan, Kashmiri political groups, and various international observers.

A special documentary released on Kashmir Exploitation Day highlights the decades-long conflict in Indian Occupied Kashmir (IOK) and presents the perspective of Kashmiri people who oppose India’s policies in the region.

According to reports cited by human rights organizations, serious concerns have been raised regarding alleged enforced disappearances, detentions, and restrictions on fundamental freedoms in Indian Occupied Kashmir. Rights groups have repeatedly called for greater accountability, transparency, and protection of civilian rights in the disputed territory.

Reports cited by international rights organizations have also raised concerns over the security environment in IOK, where a large number of Indian security personnel operate under special laws that provide them with additional powers and legal protections.

Economic organizations in Indian Occupied Kashmir have highlighted the impact of prolonged restrictions, communication disruptions, and security measures on local businesses and tourism. They state that thousands of people dependent on tourism and related sectors have faced economic hardships.

International media outlets and human rights organizations have previously reported allegations regarding unmarked graves and human rights violations in Indian Occupied Kashmir. Indian authorities, however, have rejected these allegations and maintained that security measures in the region are aimed at preventing violence and maintaining stability.

The Kashmir dispute remains a longstanding issue between Pakistan and India. Pakistan maintains that Kashmir is an issue of the right to self-determination of millions of Kashmiris and continues to raise the matter at international forums.

India, meanwhile, maintains that Jammu and Kashmir is an integral part of the country and argues that constitutional changes introduced in 2019 were aimed at improving governance, development, and security in the region.

Despite decades of tensions, Indian Occupied Kashmir (IOK) remains one of South Asia’s most sensitive disputes, with continued debates over political rights, security measures, and the aspirations of the people living in the territory.
